UPSC Prelims 2013 question on Rajya Sabha Chairman Deputy Chairman

Consider the following statements:

1. The Chairman and the Deputy Chairman of the Rajya Sabha are not the members of that House.
2. While the nominated members of the two Houses of Parliament have no voting right in the presidential election, they have the right to vote in the election of the Vice President.

Which of the statements given above is/are correct?

  1. 1 only
  2. 2 only
  3. Both 1 and 2

Answer: B. 2 only

Statement by statement

Statement 1 is incorrect because the Deputy Chairman of the Rajya Sabha is elected from among the members of the Rajya Sabha and therefore is a member of that House. Only the Chairman of the Rajya Sabha, i.e., the Vice President of India, is not a member of the House.

Statement 2 is correct because nominated members of both Houses can vote in the Vice-Presidential election but cannot vote in the Presidential election. Therefore, only statement 2 is correct.
